Yet more millions having to be shelled out unnecessarily because of poor decisions from the top. Has anyone calculated how many millions this lot have wasted since they took over ?

It will be the team that suffers most as I wouldn't be surprised if madam now decides to call a halt to any spending on players this summer.

It's gratifying to know however that it's not just in this country that people running businesses from the smallest enterprises to the biggest corporations by and large don't have a clue what they're doing.

I'm afraid that it happens everywhere. But I believe that these people know what they are doing, they are getting richer and couldn't care less about the life of others.

http://www.independent.co.uk/sport/football/football-league/blackburn-ordered-to-pay-henning-berg-after-case-is-thrown-out-of-the-high-court-8594720.html

'Shaw and Paul Agnew, another director, attempted to argue that a meeting with Berg, at a Blackburn hotel, was only to be a “meet and greet” event. But the judge concluded that the agreement reached there paved the way to a contract which would see his contract paid in full if he was sacked.'

Shaw and Agnew verbally agreed the compensation deal when he was appointed. So Agnew is out of control too I guess.

not so much" out of control too" , but the question is more like "under the control of who?"

But the big question now is where Derek is going to get the 1 million + from that Desai said he would be responsible for, ?

The judge should really have never even let it get this far. It was obvious Venky's had no realistic defence and I'm sure as soon as he started reading their appeal he wished he'd never allowed it.

A bit more meat on then bones of Friday's fiasco

http://www.bailii.org/ew/cases/EWHC/Ch/2013/1070.html

Not 100% but is this Berg's Agent? http://en.wikipedia.org/wiki/Rune_Hauge had a couple of slapped wrists during his career

Didn't Kean resign?

I appreciate the club would have had to accept the resignation and therefore technically terminate the contract, it's just written in such a way to suggest it was the club's decision.

Perhaps it was an agreement between the clubs on paper owners and the people running the club that "resigned" sounded so much nicer for the man of dignity, after all the "owners" didn't contest his compo claim did they which they had good grounds to?

Glen Mullan; do you recognise the name of the lawyers instructing the QC for Rovers?

Not the same people who represent the tantric one who should not be named, surely?

I wonder why the Rovers QC was saying that the "owners are not in control"?

Having digested the Judgement, it is an abslutely pathetic attempt to try and avoid paying Berg. The net result is that Shaw's position is untenable in the extreme. What is also of interest is that one of the two limbs of the Club's argument would necessarily have caused the Owners to provide witness statements in support, sometheing they didn't do [and no statement from SS also].

What a keaning shambles!

The new lawyers are based in Altrincham, and state they are specialists in sports law. However I don't believe they will be publicising this case on their testimonial page. Bit of an embarrassment IMO.

Agnew was present at the meeting where they verbally agreed that no '12 month compensation clause' would be put in.

Karen Silk then writes the offer contract that evening(31st Oct) consistent with what Berg says was negotiated at the meeting. She has explicitly noted 'no 12 month compensation clause' as an instruction from Derek Shaw.

He then signs a contract 2 weeks later with a compensation clause that he was entitled to the rest of his salary - signed by Derek Shaw.

Rover didn't pay Berg the money immediately because of cash flow problems that requires advanced receipt of the parachute payments.

How much have Rovers spent on mangers over the last 2 years?

I bet we have spent more than half the premier league on coaches/managers, yet what are we left with? No-one and a massively underperforming squad.

And getting ever closer to a fatal financial disaster.

For those saying "we have to stick with Venkys, how can we pay the bills without them?" I draw your attention to Para 20 of the decision. The situation is exactly what Glen said it was. Relegation has put the Club into financial strife and they want next season's parachute payments to be brought forward to pay off Berg.

Venkys might or might not be worth billions but they are not about to spend it on BRFC.

PS Sorry RoverScot you posted while i was typing!

According to the case, the statement on the website saying Derek Shaw was not being investigated was made by Derek Shaw and he didn't allow it to be removed until 3 weeks later - hence why he is 'out of control' supposedly.

It really is about time Judges get IT savvy isn't it.

The reference to Rovers asking for the PL to bring parachute payments forwards SURELY OPENS THE DOOR FOR THE PL TO ASK QUESTIONS THEMSELVES.

As PA Sports have put it,

.......................... Berg will have effectively earnt:

- £38,596 per day for 57 days

- £183,333 for every spot he dropped them down the Championship table (12, from fifth to 17th)

- £275,000 for each goal worse he made their goal difference (eight, from +5 to -3)

- £220,000 per match (ten)

- £220,000 per goal (ten)

- £366,666 per point in the league (six)

- £2,200,000 per victory (one, a 4-1 thrashing of Peterborough in his fourth game in charge)

or if you like, one-eigth of next year's parachute payment.

Crazy times.............
